This text is an agreement between the ZHNIV-AGRO LLC online store (the "Online Store") and the user of the Online Store services (the "Buyer") and defines the terms for purchasing goods through the Online Store website. Please read this agreement carefully before purchasing goods.
Contact us1. General provisions
1.1. This Agreement is concluded between the Buyer and the Online Store when the order is placed.
1.2. Information posted on the Online Store website contains the terms of the offer to purchase goods and is a public offer under Article 633 of the Civil Code of Ukraine. Acceptance is the act of placing an order for the offered goods.
1.3. When placing an order, the Buyer agrees to the terms of this Agreement by selecting the checkbox "I have read and agree to the Agreement rules" during checkout.
1.4. Any individual or legal entity capable of accepting and paying for goods may purchase from the Online Store.
1.5. Goods are paid in the national currency of Ukraine upon delivery or by cashless bank transfer.
2. Product information
2.1. Goods are shown in the catalog through photo samples owned by the Online Store.
2.2. Each photo sample is accompanied by text information: part number, price and product description.
2.3. At the Buyer request, the Online Store manager must provide by phone, Viber or email additional information that the Buyer considers necessary and sufficient to decide on the purchase.
2.4. The product price shown on the site may be changed by the Online Store unilaterally.
2.5. If the price of goods ordered by the Buyer changes, the Online Store manager informs the Buyer as soon as possible by phone, Viber or email to confirm or cancel the order. If the Buyer cannot be contacted, the order is considered canceled.
3. Procedure for purchasing goods in the online store
3.1. Orders are accepted through the Online Store and official social media pages.
3.2. The Buyer may order any available product presented on the Online Store website. Each product may be ordered in any quantity. Orders may be placed by phone, email, Viber or independently on the site.
3.3. If a product is out of stock, the company manager must notify the Buyer by phone, Viber or email.
3.4. If a product is unavailable, the Buyer may replace it with a similar model, refuse the product or cancel the order.
3.5. The Buyer may refuse the order at any time before it is shipped by notifying the Online Store by phone, Viber or email.
4. Delivery and transfer of goods to the Buyer
4.1. Goods purchased in the Online Store are delivered by Nova Poshta LLC and the Online Store courier service.
4.2. Ordered goods are shipped within 3 business days from order confirmation by the Buyer. Sunday and official holidays are not counted as business days.
4.3. Together with the order, the Buyer receives the following documents: transport waybill issued by the courier service during delivery, sales receipt or delivery note upon request.
4.4. At the order pickup point (Nova Poshta branch) or in the courier presence (address delivery), the Buyer must inspect the ordered goods for quantity, quality, assortment and completeness.
4.5. The Buyer acceptance of goods is confirmed by payment at the pickup point (Nova Poshta branch) or in the courier presence during address delivery.
4.6. After the Buyer accepts the goods, claims regarding quantity, quality, assortment and completeness are accepted according to the procedure established by law.
4.7. If the Buyer refuses the order at delivery, the Buyer pays the Online Store delivery costs.
4.8. The Buyer is not required to compensate delivery costs if, during acceptance, the delivered goods are found to be of improper quality, quantity, assortment or completeness.
5. Order payment
5.1. Orders placed in the Online Store are paid by bank transfer or cash on receipt.
5.2. Cashless payment must be made by 100% advance transfer to the Online Store account within two business days from order confirmation.
5.3. If funds are not received, the Online Store reserves the right to cancel the order.
6. Return procedure for goods of proper quality
6.1. The Buyer may refuse delivered goods before acceptance, when receiving them from the courier or at the pickup point.
6.2. Goods may be returned to the Online Store if their appearance, consumer properties, original factory packaging and transport waybill are preserved.
6.3. Return delivery to the Online Store is paid by the Buyer.
6.4. When the Buyer returns goods of proper quality, the Online Store refunds the paid amount after return, minus compensation of the store costs related to delivery to the Buyer.
6.5. Certain categories of goods that are not subject to exchange or return under Ukrainian law (Cabinet of Ministers Resolution No. 172 of 19.03.94) may be returned only in cases provided by law. Site administration always tries to support customers and may make exceptions in special cases.
7. Personal data
7.1. By placing an order in the Online Store, the Buyer consents to the collection and processing of the provided data, including surname, name, patronymic, email, phone and address, for purchase and sale relations, consumer protection, advertising and marketing research, and consents to transfer of such data to Nova Poshta LLC, other forwarding and courier organizations and other third parties at the Online Store discretion. This provision is valid without time limitation.
7.2. The source of personal data collection is information directly and voluntarily provided by the Buyer.
7.3. The owner of the personal data provided by the Buyer is the ZHNIV-AGRO LLC Online Store.
7.4. Under the Law of Ukraine "On Personal Data Protection", the personal data subject has the rights provided by law, including access to information about data sources, location, processing purpose, access terms, third parties receiving the data, access to personal data, response to requests, objection to processing, correction or deletion of data, protection against unlawful processing, complaints to the authorized body or court, legal remedies, withdrawal of consent, information about automated processing and protection from automated decisions with legal consequences.
8. Other
8.1. The Online Store reserves the right to expand or reduce the product offering on the site, regulate access to purchasing any goods and suspend or stop sales of any goods at its discretion.
8.2. The Online Store reserves the right to initiate automatic return of goods from the postal branch on the 7th day of storage.
8.3. This Agreement must be considered in the form published on the site and must be applied and interpreted according to the laws of Ukraine.
